Terms and Conditions for elPortalO

Courtesy translation. This English version is provided for convenience. The German version (AGB) is the legally binding version; the contract language is German.

These General Terms and Conditions govern the use of the elPortalO app, the website, the coin shop at elportalo.com/coins and all associated functions, digital content, coins, diamonds, payouts, partner programs and services.

1. Provider

The provider of elPortalO is Soyer GbR. Further legal information is in the legal notice at: www.elportalo.com/impressum.

2. Scope

These terms apply to the use of the elPortalO app, the website, the official coin shop, all user accounts, live streams, chats, community functions, coins, diamonds, gifts, payouts and to partners such as streamers, agencies and coin dealers.

In addition, the community guidelines, privacy provisions, the refund policy and, where applicable, internal agreements with streamers, agencies or coin dealers apply.

3. Minimum age and use of the app

Use of elPortalO is reserved for people aged 18 and over. By registering you confirm that you have reached the age of 18 and have full legal capacity.

If we become aware that an account is held by a minor, we will ban that account. Contracts concluded by a minor without the consent of their legal representatives are provisionally ineffective under Sections 107 and 108 of the German Civil Code (BGB); amounts already paid will be refunded in that case. We ask parents and guardians to report such cases to info@elportalo.com.

For individual functions — in particular live streaming, monetisation, payouts or partner roles — additional requirements such as verification may apply.

4. User account and verification

Users are obliged to give correct information and not to misuse their account. Fake accounts, identity theft, multiple accounts to circumvent bans or limits, and fraudulent use are prohibited.

For streamers, agency owners, coin dealers and certain payment or payout functions, verification may be required. elPortalO may restrict functions until verification has been successfully completed.

5. Coins, diamonds and virtual goods

Coins, diamonds, gifts, badges, virtual benefits and other digital content are virtual goods within elPortalO. Outside the platform they have no statutory real-money value and cannot be freely exchanged for money, except within officially released payout functions.

  • Coins can be acquired through the app, the official elPortalO coin shop or coin dealers officially listed in the app.
  • External coin purchases, private payments, unauthorised deals or sales outside official channels are prohibited.
  • Coins and diamonds must not be used to circumvent rules, for fraud or for illegal offers.

6. Coin shop at elportalo.com/coins

In the official coin shop, users can buy coin packages for elPortalO. Delivery takes place after successful payment, automatically or manually, to the elPortalO ID given.

  • The user is obliged to enter their elPortalO ID correctly.
  • Coins are only credited after successful and completed payment.
  • Digital goods already delivered are generally excluded from refunds, to the extent legally permissible.
  • In the case of technical errors, double payments or failed delivery, a review can take place through support.

7. Right of withdrawal and refunds

Withdrawal notice for consumers

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us — Soyer GbR, Ahornstraße 110, 84030 Ergolding, Germany, email: info@elportalo.com — of your decision to withdraw from this contract by means of a clear statement (for example a letter sent by post or an email). You can use the model withdrawal form printed below for this, but it is not mandatory. To meet the withdrawal period, it is sufficient that you send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we must reimburse all payments we have received from you without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this reimbursement.

Early expiry of the right of withdrawal

Coins are digital content that is not supplied on a physical data carrier. Your right of withdrawal expires early if we have begun performing the contract after you have expressly agreed that we begin performance before the withdrawal period has expired, and you have confirmed your awareness that by this agreement you lose your right of withdrawal once performance begins, and we have sent you a confirmation of the contract under Section 312f BGB (Section 356(5) BGB).

You confirm both actively in the order process by ticking the corresponding declaration. If you do not give this agreement, the coins are credited only after the withdrawal period has expired.

Purchases through the app stores

Purchases you make through Google Play or the Apple App Store are contracted with the respective store operator. Its refund rules additionally apply to these purchases. Further information is in our refund policy.

8. Payouts

Payouts can generally be requested by eligible users, provided the technical, legal and internal requirements are met. The minimum payout is 25 euros.

  • Verification may be required for payouts.
  • elPortalO may review, delay, reject or freeze payouts if fraud, rule violations or abuse are suspected.
  • Illegally, manipulatively or fraudulently obtained coins or diamonds can be corrected or deducted retroactively.

9. Partners, streamers, agencies and coin dealers

Partners such as streamers, agencies and coin dealers must comply with these terms, the community guidelines, data protection requirements and internal agreements. Violations can lead to restriction, termination of the cooperation or a ban.

elPortalO can set additional requirements for partners, in particular verification, proof, quality standards, billing rules and security requirements.

10. Prohibited use

Using elPortalO for unlawful, harmful, fraudulent or abusive purposes is prohibited.

  • No nudity, pornography, escort, sugar daddy, adult or sexual offers.
  • No violence, drugs, weapons, hate speech, terrorism or illegal content.
  • No attempts at fraud, fake giveaways, spam, bots, phishing or identity theft.
  • No external payments for services, content or coins outside official elPortalO channels.
  • No infringement of copyright, trademark rights or personality rights.

11. Moderation, AI systems and measures

elPortalO may review content, live streams, profiles, messages, payments, coins, diamonds and activities technically, manually or with AI support. In the event of violations, elPortalO may take appropriate measures.

  • Remove or block content
  • End or restrict live streams
  • Warn, restrict or ban accounts
  • Freeze, correct or deduct coins, diamonds, benefits or payouts
  • Withdraw partner, agency or dealer status
  • In the case of serious violations, initiate legal steps or reports to the competent authorities

12. Availability and technical changes

elPortalO strives for stable availability of the app, website and services. However, error-free or uninterrupted use at all times cannot be guaranteed.

Functions, prices, coin packages, exchange rates, payout rules, features or technical processes can be changed, extended or removed where this is necessary for technical, economic, legal or security reasons.

13. Liability

elPortalO is liable in accordance with the statutory provisions in cases of intent, gross negligence and injury to life, body or health. For simple negligence, elPortalO is only liable for breach of essential contractual obligations and limited to the foreseeable damage.

elPortalO accepts no responsibility for content, actions or statements of users, streamers, agencies or third parties, to the extent legally permissible.

14. Data protection

Information on the processing of personal data is in our privacy policy: open privacy policy.

15. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in the European Union, mandatory consumer protection provisions of your country of residence remain unaffected.

The place of jurisdiction is Landshut if you are a merchant, a legal entity under public law or a special fund under public law, or have no general place of jurisdiction in Germany. Towards consumers, the statutory places of jurisdiction apply.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (Section 36 of the German Consumer Dispute Resolution Act).

The contract language is German. Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.

These terms apply to the website, coin shop and app. Supplementary agreements may apply to individual functions or partner roles.
